These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User") and Coffee on Chain ("Company," "we," "us," or "our"), governing your access to and use of the BrainStake application ("App"). By connecting your Solana wallet, accessing the App, or participating in any game or prize pool, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Eligibility

You must be at least eighteen (18) years of age. You are solely responsible for determining whether your use of the App complies with the laws of your jurisdiction. You may not use the App if you are located in any jurisdiction subject to comprehensive economic sanctions (such as OFAC-designated countries).

2. Account and Wallet

The App uses wallet-based authentication via Solana. We never access, store, or control your private keys, seed phrases, or wallet credentials. All transactions are initiated and signed by you. You are solely responsible for maintaining the security of your wallet.

3. Description of Services

BrainStake is a skill-based trivia game on the Solana Mobile Seeker dApp Store. The App offers Free Daily Challenges (no staking required), Paid Prize Pools (daily competitions where users stake SOL), and Community Pools (user-created pools). The App may operate on Solana Devnet during development phases.

4. Game Rules and Fair Play

Scores are determined by correctness and response time. You agree to play fairly and honestly, not use bots or automated tools, and not exploit bugs or vulnerabilities. Results are final once recorded on-chain.

5. Staking and Prize Pools

Prize pool competitions are skill-based trivia contests, NOT gambling. Rewards are distributed proportionally based on quiz performance. There is NO guarantee of profit or return. Entry stakes are final and irreversible once confirmed on the Solana blockchain. Only stake amounts you can afford to lose.

6. Fees

We charge a service fee of five percent (5%) on prize pools, deducted before rewards are distributed. For Community Pools, the fee is split 2.5% to the platform and 2.5% to the pool creator. Solana network transaction fees are separate and paid by you.

7. Blockchain Risks

You acknowledge risks including smart contract bugs, network congestion, transaction irreversibility, cryptocurrency volatility, regulatory changes, and wallet/third-party failures. We are not liable for any loss resulting from these risks.

8. No Custody of Funds

The App is non-custodial. We never hold, control, or have access to your funds. All transactions are executed through smart contracts on the Solana blockchain. We cannot recover lost funds or reverse transactions.

9. Intellectual Property

All content in the App is the property of Coffee on Chain or its licensors. You may not copy, modify, distribute, or create derivative works without written consent.

10. Prohibited Conduct

You agree not to: use bots or automation, cheat or collude, exploit vulnerabilities, use the App for illegal activity, create multiple accounts for unfair advantage, or interfere with the App's operation.

11. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. Nothing in the App constitutes financial, investment, tax, or legal advice. SOL staked into prize pools is an entry fee for a skill-based competition, not an investment.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COFFEE ON CHAIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Our total liability shall not exceed the greater of (a) service fees paid in the preceding 12 months, or (b) $100.

13. Indemnification

You agree to indemnify and hold harmless Coffee on Chain from any claims arising from your use of the App or violation of these Terms.

14. Privacy

We collect wallet addresses, game activity, transaction data, and optional profile data (X/Twitter). On-chain data is publicly visible. We do not sell personal data or collect private keys. Please review our full Privacy Policy for details.

15. Modifications

We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance.

16. Termination

We may suspend or terminate access at any time for any reason. On-chain data persists regardless of termination.

17. Dispute Resolution

Disputes shall be resolved through binding arbitration after a 30-day informal resolution period. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION.

18. Governing Law

These Terms shall be governed by the laws of the jurisdiction in which Coffee on Chain is incorporated.
